Non-Cooperation (01)

The proposed agenda for the meeting would be as follows:

  1. Briefing on the procedures on non-cooperation;

     
  2. As mandated by the omnibus resolution adopted by the Assembly at its thirteenth session, an initial exchange of views on the review of the effectiveness of the procedures and their implementation would be conducted. For this segment, participants would be invited to comment on the procedures and to provide feedback on possible areas of improvement in relation, inter alia, of the following issues:

     

    a.   Monitoring potential instances of non-cooperation

    b.   Preventing instances of non-cooperation: informal actions

      i.          The role of the President and the focal-points

      ii.         Enhancing the responses by States Parties

      iii.        The role of civil society

    c.   Judicial findings on non-cooperation

      i.          The role of the Bureau

      ii.         The role of directly-concerned states

      iii.        The role of the Assembly of States Parties

     

     
  3. On the basis of, but not limited to, the enclosed list of issues from the brainstorming session organized in 2014 by Belgium and Uruguay, participants would be invited to express areas in which the focal points could focus during 2015.


The main outcomes from this first consultation would be to:
 

  1. Increase awareness about the procedures on non-cooperation, and the role of the President and the focal points;
  2. Determine areas of implementation to be kept under review throughout 2015; and
  3. Determine one topic for focused discussion, which would be the subject of the second consultation on non-cooperation to take place in June/July.

For purpose of this meeting the focal points wish to bring to the attention of the delegates the enclosed documentation:

  1. Procedures of the Assembly on non-cooperation, ICC-ASP/10/Res.5 as amended by ICC-ASP/11/Res. 8, annex.1, also available at http://icc-cpi.int/en_menus/asp/non-cooperation; and
  2. List of ideas resulting from the brainstorming session organized by Belgium and Uruguay in June 2014.
