The Presidency of the International Criminal Court (“ICC”) has referred Pre-Trial Chamber I’s “Finding under article 87(7) of the Statute on Hungary’s non-compliance with the Court’s request to cooperate in the provisional arrest of Benjamin Netanyahu and referral to the Assembly of States Parties”, dated 24 July 2025, to the President of the Assembly of States Parties.
The Pre-Trial Chamber found that by failing to provisionally arrest Mr. Netanyahu while he was present on Hungarian territory between 3 and 6 April 2025, Hungary failed to comply with its international obligation under the Statute. In so finding, the Pre-Trial Chamber recalled that Hungary’s withdrawal from the Rome Statute will not take effect until 2 June 2026 and that Hungary remains bound to comply with its obligations under the Statute until that time. The Pre-Trial Chamber referred Hungary’s non-compliance through the President of the Court to the Assembly of States Parties in accordance with regulation 109(4) of the Regulations of the Court.
In accordance with resolution ICC-ASP/17/Res. 5, annex II, paragraph 14, the matter will be taken up by the Bureau of the Assembly at its next meeting, and a representative of Hungary will be invited to present its views. Pursuant to paragraph 15 of the same annex, the Bureau will submit a report on the action taken, along with any recommendations, to the next session of the Assembly.
The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified and acceded to the Rome Statute.
